A hearing to decide if the man accused of opening fire on a Colorado movie theater should stand trial might not be held until January.

A lawyer for James Holmes told the judge in the case Thursday that the defense must review thousands of pages of evidence before a preliminary hearing can be held. That hearing currently is scheduled for November.

Prosecutors said they, too, could use more time to gather evidence.

Judge William Sylvester said he will decide later this month whether to delay the hearing until January. The hearing will consist of a public airing of evidence against Holmes.

The 24-year-old is charged with killing 12 people and wounding 58 others in the July 20 shooting in the Denver suburb of Aurora. He has yet to enter a plea.

Holmes appeared in court Thursday in leg shackles and a red jail jumpsuit. He still has short brown hair, long sideburns and a mustache.

He looked straight ahead at no one in particular. He periodically widened his eyes, causing wrinkles in his forehead.

Also Thursday, mediator Ken Feinberg begins meeting with shooting victims and their families as he decides how to distribute $ 5 million in charitable donations to them.

Question by Abby: Can half white&half asian people say there "country"? I have a friend and her mom is asian and her dad is white, and she was born and raised in the country. She rides four wheelers and horses,her family has a ranch and stuff, and she listens to country music. People at school say she cant consider herself to be a "country girl" because shes not fully white. Do you think thats fair or right? If she was born and raised country, then she's country. Color is only an issue if the person is a racist.

Anyone can be "country", i have seen even full blooded italians (yes i know they're white, but they're not known for being "country") who were hillbillies when i visited south carolina.

She's as country as they come, if that's her background. What the hell do they mean "not fully white"? I call some of my VERY country friends from the South country all the time, regardless of race! The people in your school need to shut the fúck up.

No one can say they are country because that would mean they are a land with borders. But they can say they are from the country and like the country.

"Country" is a place where you grow up and a lifestyle you live, not what race you are . People are just really stupid if they say otherwise. Are the people saying she can't be a "country girl" ignorant, backwards rednecks? Seems like that might be the case.
